Many brokers are aware that using an AI tool for product recommendations can violate New Zealand law. However, it’s important to note that the Financial Markets Authority (FMA) believes that companies can confidently implement AI as long as they have proper governance and consumer protection measures in place.

This session outlines a method for ensuring compliance and differentiates between binding requirements for a licensed Financial Advice Provider (FAP) and guidance or voluntary measures. It clarifies when a productivity tool transitions into regulated advice, evaluates AI-generated file notes in relation to the seven-year record-keeping obligation, and discusses tools that principals lack visibility into.

Each section follows a consistent format: it identifies a specific risk and then outlines the remediation steps. This will be displayed on screen so you can easily note what is relevant to your firm. By the end of the presentation, you will have a clear understanding of which practices fall under your existing obligations, which do not, and what should be prioritised for action.
