The Commerce Act applies to all businesses operating in New Zealand and prohibits anti-competitive conduct. However the types of conduct captured by the cartel provisions has widened because of amendments to the Commerce Act in the last 5 years, and breaching the cartel provisions is now a criminal offence punishable by up to 7 years in jail.
This session will provide an overview of the obligations under the Commerce Act, and what red flags to look out for that may give rise to potential concerns. This is particularly timely in light of the Commerce Commission limited market study and greater focus by the Commerce Commission on the insurance industry.
